TUDI Response to PA 3-23-20 Order

Re:  Pennsylvania Governor Tom Wolf’s March 23, 2020 Order (“Order”)

Date:  March 23, 2020

This Memorandum is intended to provide TUDI Mechanical Systems, Inc.’s (“TUDI”) employees, customers and subcontractors its positions on what work is permissible under Pennsylvania Governor Tom Wolf’s March 23, 2020 Order.

We have consulted with our legal counsel and believe we may lawfully perform the following work:

A.  Consumer Service Calls. The Order permits repair and maintenance for “Personal and Household Goods.” We understand that the Order permits TUDI to perform service calls with individual or consumer customers to repair and maintain their existing home HVAC systems.

B.  Commercial and Industrial Equipment. Although all new construction appears to have been shut down, the Order permits the repair and maintenance of “Commercial and Industrial Machinery and Equipment.” TUDI understands that the Order permits the repair and maintenance of existing commercial equipment and machinery, which includes HVAC, plumbing and electrical equipment.

TUDI fully intends to comply with the Order and will not be performing any prohibited construction work.

However, TUDI believes that certain work as outlined above may be lawfully performed by TUDI and TUDI intends to continue performing this work.
